Misrepresentation of Transmission Data Rate

The data rate of a network (also known as bandwidth, throughput or capacity) is one of the most important parameters taken into account when consumers and professionals alike consider purchasing network equipment. Therefore, it is a strong incentive for manufacturers and service providers to over-estimate the performance of their devices and services.

In two separate occasions (for different classes of network devices and services) class action suits were brought both against several service providers advertising the service as well as several manufacturers that misrepresented the performance of their devices. Both theoretical arguments, as well as performance measurements supported the conclusion that, even in best-case scenarios, the products and services were grossly misrepresented.
