Mathias Vs Howell

Was asked to investigate a set of stairs where a person fell to see if the stairs were in conformance with the Building Codes when they were built. Determined that the City told the contractor how to build the stairs and that the contractor followed their direction. No depositions were taken. Represented the defendant.

Rosenthal Vs Sinrud

This case had to do with the constructability of a set of drawings for a large home prepared by a drafting service. Developed three dimensional drawings to determine beam lengths and bearing points and compared this data with the data provided by the drafting service. Preliminary findings were reviewed by both parties. No depositions were taken. Represented the plaintiff.

Evan Vs O’Dell

Asked to review all documentations pertaining to the design and construction of a large home that was designed by a Montana licensed architect. Determined that the architect acted well beyond his legal authority by authorizing changes to the plans and cost without the owners knowledge. This case was settled with the architect’s insurance company. No depositions were taken. Represented the plaintiff.

State Farm Vs Buller

A subcontractor was being sued by an owner over a fire that burnt down a home under construction. Reviewed the drawings and correspondence prior to preparing a preliminary report. The subcontractor was dropped from the suit. No depositions were taken. Represented the defendant.

Abbey Vs OZ

Reviewed correspondence between the owner, contractor and architect to see if the owner had any grounds to sue the architect because of cost over runs. Found nothing that would support that conclusion. Represented the plaintiff.

Dobler Vs Triple Divide

Hired by a contractor to review the drawings for a profession office building that were prepared by a Montana licensed architect. Determined that the drawings and actions of the architect did not meet the “standard of care” for a licensed architect. Depositions were taken but a settlement was reached prior to going to court. Represented the defendant.

Schuttes Vs Capdevielle

This was a large home in Missoula that was designed by a Louisiana Architect. The windows and exterior doors specified by the architect were not fitting for the climate and the house could not be heated. There were also overruns in the construction cost by more then $1,000,000. Although the general contractor was required to solicit bids he treated the project like a cost plus. The architect did not provide services meeting the standard of care. No depositions have been taken. There were two days of mediation. Represented the defendant.

Maxon Vs Graves

Case involved a first time home builder who sold the home to another party. After they moved in they found several items that need to be fixed. When a roof leak appeared the new owners notified the builder that they wanted the entire roof framing replaced. Found several minor errors in framing that could be easily fixed. Noted that there were no building codes for residences built outside of a Cities jurisdiction. Therefore “let the buyer beware”. Defendant settled by paying Maxon a minimal amount. Represented the defendant.
